It is the customer’s responsibility to know and comply with all applicable federal, state, and local laws in his or her jurisdiction prior to purchasing any product from Old Town Tactical.
No product offered for sale by Old Town Tactical will knowingly be shipped, transferred, or sold to any person in any jurisdiction where it is unlawful for that person to receive, purchase, possess, or use such product.
This general policy does not apply to law enforcement agencies, government agencies, official end users, licensed dealers, and other parties with the proper licenses, permits, or authorizations, provided appropriate proof of such authorization and proper identification are presented when required.
LEGAL COMPLIANCE
Old Town Tactical shall have no liability to any customer arising from the customer’s intentional or unintentional violation of any applicable federal, state, or local law. By placing an order with Old Town Tactical, you represent and agree that:- All information provided during the ordering process is accurate and complete.
- You are legally permitted to purchase, receive, possess, and use the products ordered.
- All products purchased will be used in a lawful manner.
- You will comply with all applicable federal, state, and local laws and regulations.
- You will obtain any required licenses, permits, approvals, or authorizations.
- No product will be exported, transferred, or otherwise transported outside the United States without all required licenses, permits, and authorizations.
DISCLAIMER OF LIABILITY
Neither Old Town Tactical nor any of its affiliates, licensors, partners, owners, managers, shareholders, directors, officers, employees, contractors, or other agents shall be liable to any customer, user, principal, or agent for any damages, whether general, special, direct, indirect, incidental, consequential, or punitive, including lost profits, lost savings, loss of use, or other economic losses, whether or not foreseeable and whether based on contract, tort, common law, statute, regulation, or any other theory of liability. As a customer, purchaser, or end user of our products, you expressly acknowledge and agree that Old Town Tactical provides its products and related information in reliance upon the disclaimers and limitations set forth in these Terms and Conditions. You further acknowledge and agree that these limitations are reasonable. To the maximum extent permitted by applicable law, Old Town Tactical’s total liability to you shall not exceed the actual purchase price paid by you for the specific product giving rise to the claim.PRODUCT USE AND RESPONSIBILITY
Old Town Tactical is not responsible for:- The use or inability to use any product offered for sale, or the suitability of any product for a particular task or purpose.
- Any damages, loss, cost, injury, or damage of any kind arising from the misuse, improper use, or unauthorized use of any product.
- Any claims arising, in whole or in part, from improper, careless, negligent, or unsafe handling or use of a product.
- Unauthorized modifications, alterations, repairs, or changes to any product.
- The use of improper, defective, incorrect, hand-loaded, or reloaded ammunition or other incompatible components, where applicable.
- Abuse, neglect, corrosion, improper storage, improper maintenance, or other conditions beyond our direct control.
- Any injury, death, or property damage resulting from the intentional or accidental discharge, misuse, or improper operation of any firearm or related product.
- The use of a product for any purpose for which it was not designed or intended.
- Incidental or consequential damages, including loss of use of property, loss of earnings, loss of profits, business interruption, or any other commercial or residential loss.
RETURNS AND EXCHANGES
All products sold by Old Town Tactical are new and covered by the applicable manufacturer’s warranty unless otherwise stated in the product description. If a product is defective, customers should contact Old Town Tactical as soon as possible after receiving the product for instructions regarding the applicable return or warranty process.Return Eligibility
Subject to applicable law and the terms below, unused, unopened, and eligible products may be returned within 30 days of receipt. A restocking fee of up to 15% may apply to eligible returns. Products that are unused and unopened may be eligible for return within 10 days of the shipping date for a refund of the applicable product purchase price, less any applicable payment processing, credit card, packaging, or restocking fees, unless the return is due to an error by Old Town Tactical. NO REFUNDS WILL BE ISSUED FOR PRODUCTS RETURNED AFTER 30 DAYS FROM THE DATE OF RECEIPT, except where otherwise required by applicable law or covered by an applicable warranty. A 15% restocking fee may be charged for eligible products returned after the applicable 10-day shipping-date return window.Order Cancellations
Orders cannot be canceled once they have been processed for fulfillment. Customers should contact Old Town Tactical as soon as possible if they wish to request a cancellation. A cancellation request is not guaranteed until confirmed by Old Town Tactical.Return Shipping
The customer is responsible for return shipping costs unless the return is required because of an error in order processing by Old Town Tactical or the product is defective, subject to applicable warranty and return procedures.Final Sale Items
Sales are final on:- Sale items
- Discontinued products
- Clearance merchandise
- Custom or specially finished products
- Cerakoted or otherwise customized products
- Special-order products
- Any product specifically identified as final sale
